Marketing You Haven’t Tried, a single-member SARL (EURL) with share capital of €1,000, registered with the Paris Trade and Companies Register under no. 940 217 961. The Website is hosted by Wix.com Ltd., 40 Namal Tel Aviv St., Tel Aviv 6350671, Israel. Online payments are processed via Mollie in partnership with Qonto.

Article 1 – Purpose

These Terms and Conditions govern the contractual relationship between the Provider, Marketing You Haven’t Tried, headquartered at 81 rue Desnouettes, 75015 Paris, France, and any individual or legal entity (the "Client") requesting its services.

Marketing You Haven’t Tried is a registered trademark with the INPI.
​
Article 2 – Acceptance of Terms
​
Validation of a quote or order form implies full acceptance of these Terms and Conditions by the Client.
​
Article 3 – Description of Services
​
The Provider offers marketing consulting services including strategy, lead generation, content creation, events, coaching, marketing training, and fractional CMO assignments. The exact scope of services is specified in quotes and proposals.
Article 4 – Website Access
​
Website access does not require the creation of a user account. Services are accessed through a contact form or direct request.
​
Article 5 – Orders​
​
All orders are confirmed through acceptance of a quote and/or order form. An invoice is then sent electronically. Payment is due as per the terms specified on the invoice.

Article 6 – Pricing Terms​​
​
Prices are stated in euros, excluding tax.
​
A deposit is required upon signing: 50% for short-term assignments or engagements under 3 months; the first two (2) months for engagements exceeding 3 months. Once the deposit has been used, services are billed monthly in arrears based on work performed.

Article 7 – Timeframes​
​
Timeframes are provided for reference only. The Provider agrees to carry out services within a commercially reasonable timeframe.

Article 8 – Client Testimonials and Logos​
​
Client testimonials and logos displayed on the Website remain the property of their respective owners.
​
Article 9 – Client Obligations​
​
The Client agrees to cooperate actively with the Provider, supply accurate information, and validate deliverables within the agreed timeframe.

Article 10 – Confidentiality​
​
Both parties agree to maintain the confidentiality of any information exchanged during the engagement.

Article 11 – Liability​
​
The Provider is bound by a best-efforts obligation. It shall not be held liable for indirect or consequential damages.

The Provider shall not be liable:

in the event of force majeure under Article 1218 of the French Civil Code (e.g. strikes, pandemics, riots, fires, etc.)

where the Client provides incorrect or incomplete information;

if the Client disables cookies essential for the operation of the Site;

if the Site’s functionalities are incompatible with the Client’s equipment.

In any case, the Provider’s total liability is limited to the pre-tax amount received from the Client for the Services during the twelve (12) months preceding the event.
Any legal action by the Client must be initiated within one (1) year of the event giving rise to the claim.

Article 12 – Force Majeure​
​
The Provider shall not be held liable in the event of force majeure as defined under French law.

Article 13 – Personal Data​
​
The processing of personal data is governed by our Privacy Policy, available on the website.

Article 14 – Complaints​
​
All complaints must be submitted in writing to: hello@myht.io

Article 15 – Intellectual Property​
​
All materials (text, visuals, content) created by the Provider remain its intellectual property unless otherwise stated. The Client is granted a limited right of use for professional purposes only.

Article 16 – Term​
​
For one-off assignments, these Terms and Conditions apply for the duration of the engagement.
For long-term assignments (e.g., 3 days per week over 6 months), the term is specified in the quote or order form. Renewal may occur by mutual agreement.

Article 17 – Governing Law & Jurisdiction​
​
These Terms and Conditions are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Paris.

Article 18 – Modifications​
​
The Provider reserves the right to modify the content or location of the Website, the Services, or these Terms at any time without prior notice.

Article 19 – Hyperlinks​
​
The Website may contain hyperlinks to third-party websites. The Provider shall not be held liable for the content or privacy policies of such sites.
